Welcome to santé. The terms 'we', 'us' and 'our' refer to Sante Cosmetics Limited (Company No. 16257057), trading via our online store hosted by Shopify. We provide access to our products and services (the 'Services') through this website, subject to the terms and conditions outlined below.

By accessing or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy available at sante.skin/policies/privacy-policy. If you do not agree to all terms, you must not use the Services.

1. Eligibility and Account Responsibility

To use the Services, you must be at least the age of majority in your country of residence. You agree to provide accurate and current information when placing orders or registering an account, and to keep your information up to date.

You are responsible for maintaining the confidentiality of your account details. We are not liable for any unauthorised use of your account.

2. Products and Descriptions

We aim to describe our products as accurately as possible. However, product imagery may vary depending on screen settings and lighting.

We reserve the right to modify, discontinue, or limit quantities of any product at our discretion, without prior notice.

3. Orders

Your order is an offer to buy. We accept it when we email to confirm it, and a contract between us is then formed. If we cannot accept an order, we will tell you and take no payment, or refund it at once. After we accept, we will cancel only if a product is unavailable, if there is an obvious error in its price or description, or if we have good reason to suspect fraud, and we will tell you and refund you in full.

If you would like to change or cancel an order, tell us as soon as you can. You may cancel at any time until 30 days after it arrives, and you do not need to return anything; our refund policy explains how.

4. Pricing and Payment

All prices are in pounds sterling. Delivery within the United Kingdom is complimentary, and there are no further charges at checkout.

Sante Cosmetics Limited is not currently VAT-registered, so no VAT is charged at checkout.

You agree to provide complete and accurate payment information and authorise us to charge your selected payment method accordingly.

5. Delivery

Delivery within the United Kingdom is complimentary on every order. The delivery times we give are estimates. Your order is our responsibility until it reaches you, or a person you have asked us to deliver to. If it is lost or arrives damaged, tell us and we will send it again or refund you in full, as you prefer. If it has not arrived within 30 days of your order, you may cancel it for a full refund.

6. Intellectual Property

All content and materials on this website — including logos, product names, images, text, and graphics — are the intellectual property of Sante Cosmetics Limited or its licensors. You may not use or reproduce any content without our prior written permission.

7. Third-Party Services and Tools

We may provide access to third-party tools or services. These are provided 'as is' and 'as available' without warranties or endorsements. Your use of such services is entirely at your own risk.

Links to third-party websites are provided for your convenience. We are not responsible for their content, terms, or practices. Please read their terms carefully before using their services or making purchases.

9. Shopify Platform

Our online store is hosted by Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you. All transactions are between you and Sante Cosmetics Limited. Shopify is not responsible for order fulfilment or customer service.

10. Feedback and reviews

If you send us feedback or a review, you allow us to publish it on our website and in our own communications, with the name you choose to show. We will not change its meaning, and we may shorten it or remove personal details. You may ask us to take it down at any time, and we will. Please post nothing unlawful, abusive or untrue.

11. Errors and Omissions

Occasionally there may be errors or omissions relating to product descriptions, pricing, or availability. We reserve the right to correct these and cancel any affected orders without prior notice.

12. Prohibited Use

You must not misuse our site or Services. Prohibited activities include using the Services for illegal or fraudulent purposes, interfering with the functionality or security of the site, transmitting harmful code or spam, and violating intellectual property rights.

We reserve the right to suspend or terminate access for any breach of these terms.

13. Suspending access

We may suspend or end your access to this website or your account if you break these terms or misuse the Services. This does not affect any order we have already accepted, or your rights in it, including any refund due to you.

14. Our products and this website

Our products come with the rights the law gives you: they must be of satisfactory quality, fit for their purpose and as described. If something is not, our refund policy explains what we will do, and your rights under the Consumer Rights Act 2015 remain in full. We cannot promise that this website will always be available or free of errors, and when it is not, we will put it right as quickly as we can.

15. Our responsibility to you

If we break these terms, we are responsible for loss you suffer that was a foreseeable result. We are not responsible for loss that was not foreseeable. We sell our products for personal use only, so we are not responsible for any loss of business or profit. Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under the Consumer Protection Act 1987, or for breach of your rights under the Consumer Rights Act 2015.

16. Indemnity

You agree to indemnify and hold harmless Sante Cosmetics Limited, its directors, employees, and agents from any claims or liabilities arising from your breach of these Terms or misuse of the Services.

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Our failure to enforce any right shall not constitute a waiver. These terms, our refund, shipping and privacy policies, and what we tell you about a product on its page or in writing before you order, make up the agreement between us.

19. Assignment

You may not assign these Terms to another party without our written consent. We may transfer our rights and obligations without notice.

20. Law and courts

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts, and the law where you live continues to protect you.

21. Changes to Terms

We reserve the right to amend these Terms at any time. Changes will be posted on this page, and your continued use of the Services constitutes acceptance of those changes.
